India's Solid Waste Management Rules 2016 have been replaced by the SWM Rules 2026, effective April 1, 2026. The new rules introduce four-stream waste segregation, stronger accountability for bulk generators, new roles for Material Recovery Facilities and a centralised online tracking portal. If your business generates significant amounts of solid waste, these rules directly affect you.
Under the new rules, waste must be segregated at source into four categories:
A business or building is classified as a bulk waste generator if it meets any one of these criteria:
Bulk generators must fulfil waste processing responsibilities โ either by processing waste themselves or by purchasing certificates from local bodies or licensed waste processing facilities.
MRFs are now formally recognised under the rules as facilities for sorting solid waste. Local bodies are responsible for waste collection, segregation and transportation to MRFs. MRFs also serve as drop-off points for e-waste, sanitary waste and other waste streams.
Non-recyclable plastic, paper and textiles with high calorific value can be processed into Refuse Derived Fuel (RDF). Industrial units, cement plants and waste-to-energy facilities are mandated to progressively replace conventional solid fuel with RDF.
CPCB will develop a centralised online portal to track all stages of solid waste management โ from generation to disposal. This replaces the previous physical reporting system.
Environmental compensation is levied based on the Polluter Pays principle for non-compliance. This includes operating without registration, false reporting, forged documents and improper solid waste management practices.
